Abstract

This research is intended to answer the formulation of the problem. First, how is the practice of buying and selling cakes there? Second, how is the analysis of Islamic economics and Law number 8 of 1999 concerning consumer protection?
From the problems above, the data collected comes from books, journals, documents, publications, and other research results. The analytical method used in analyzing the problem above is descriptive analytical with an inductive mindset. This was done by collecting data on the practice of buying and selling cakes in the micro-enterprise unit of Kalitengah village, then concluded based on an analysis of Islamic economics and Law Number 8 of 1999 concerning consumer protection.
From the results of this study, it was found that the practice of buying and selling cakes carried out in the micro business unit of Kalitengah village was in accordance with the principle of the Istishna^ buying and selling contract with an order system, however, it is unfortunate that there was a discrepancy between the goods received and the goods ordered, resulting in new legal problems. namely khiyar aib. That is a situation where the buyer has the right to return the defective item or compensation from the seller. Meanwhile, in the Consumer Protection Law, the seller has violated Article 16 of this Law, so that the liability obligations stipulated in Article 19 will arise.
Based on the conclusions above, the writer suggests the seller to be more careful and consider his ability to fulfill orders requested by consumers. As for buyers, the authors suggest that consumers are more critical and careful in ordering cakes so that there are no production errors that can harm buyers as consumers.
